Kashmir LIVE: In an announcement with massive repercussions for Jammu and Kashmir, Home Minister Amit Shah has announced in Rajya Sabha that the government has decided to repeal Article 370 of the Constitution which grants special status to J&K. The government has also decided to bifurcate the state into two Union territories – Jammu and Kashmir, which will have a legislature, and Ladakh, which will be without a legislature.
As per the order, there will be no movement of public and all educational institutions shall also remain closed. There will be a complete bar on holding any kind of public meetings or rallies during the period of operation of this order.
The rupee was trading down by 77 paise at 70.37 against the American currency on Monday, amid uncertainty over Kashmir Issue and US-China trade related concerns. Here’s what we know so far:
– Article 370, which confers special status to Jammu and Kashmir, will be removed, said Home Minister Amit Shah in parliament this morning.
– The announcement came after Prime Minister Narendra Modi held a meeting of his cabinet at his house this morning.
-Article 370 gives Jammu and Kashmir its own constitution and decision-making rights for all matters barring defence, communications and foreign affairs.
– The removal of this part of the constitution ends special status for Kashmir, which was key to its accession to India in 1947.
– Article 370 made it necessary for the centre to get the state legislature’s approval for introducing any policies or constitutional powers to the state. This in turn means that the Governor, who is being treated as the ‘State’ govt at the moment, was able to move the resolution to the President.
– Jammu and Kashmir will consist of two Union Territories – Ladakh and Kashmir; the former will not have a legislature.
Making the announcement on bifurcation of Jammu and Kashmir in Rajya Sabha, Union Home Minister Amit Shah said the UT in Ladakh will have no legislature like Chandigarh while the other UT of Jammu and Kashmir will have a legislature like Delhi and Puducherry. Shah introduced the Jammu and Kashmir Reorganisation bill.
‘Glorious day,’ writes Ram Madhav | BJP leader Ram Madhav on Monday hailed the government’s decision on Article 370 in Jammu and Kashmir and said the martyrdom of its idealogue Dr Shyama Prasad Mukherjee for complete integration of the state into India has been “honoured”.
The national general secretary and the party’s point person in the state said that the complete integration of Jammu and Kashmir was a longstanding demand of the nation.
Continuing his address in Rajya Sabha, Amit Shah says that two Lt Governors have been proposed, one for Jammu and Kashmir and one for Ladakh. Unfazed by the solganeering by Opposition, the Union Home Minister adds that there should be no delay in the removal of Article 370.
Ghulam Nabi Azad, who is currently addressing the House rues that by revoking Article 370 that accords special status to Jammu and Kashmir, the BJP-led government has murdered the Consitution of India. “Azad: We stand by the constitution of India…we are willing to give up our lives for the constitution, but we condemn any act against the Constitution,” he says.

Decoding Presidential Order | The presidential order on 370 states that everything in the Indian Constitution will apply to Jammu and Kashmir and the Constituent Assembly in Article 370 (3) has been changed to legislative assembly. This in turn means that the Governor, who is being treated as the ‘State’ govt at the moment, was able to move the resolution to the President.

What Does Article 370 Say | Included in the Constitution on October 17, 1949, Article 370 exempts J&K from the Indian Constitution (except Article 1 and Article 370 itself) and permits the state to draft its own Constitution. It restricts Parliament’s legislative powers in respect of Jammu and Kashmir. Article 35A stems from Article 370, having been introduced through a Presidential Order in 1954. Article 35A empowers the J&K legislature to define the state’s permanent residents and their special rights and privileges.

Industrialist Anand Mahindra on Monday morning weighed in on the prevailing uncertainty in Kashmir that was dramatically heightened when the Centre put three of the Valley’s most prominent politicians under house arrest and imposed Section 144. As a decision on Jammu and Kashmir is likely in Parliment today, Mahindra writes, “Cannot pretend this is just another Monday morning. The entire country is waiting to exhale over Kashmir. Can only pray for the safety of everyone there & for an outcome that makes the nation stronger and the future more positive.”
Union Home Minister Amit Shah is also likely to introduce the Jammu and Kashmir quota bill in the Rajya Sabha today for the implementation of the 10 per cent Economically Weaker Section (EWS) quota in Jammu and Kashmir. Earlier, the Parliament had passed the Jammu and Kashmir Reservation (Amendment) Bill, 2019 which provides people living near the International Border benefits like reservation in jobs, promotion and education institutions on par with those living along the Actual Line of Control (ALoC).
